Terms of Service – Peeker, Inc.

1. Acceptance

By creating a Peeker account or using the Services, you agree to these Terms and our Privacy Policy.

2. Your account

• You must be 18 or older.
• Keep credentials secret; you're responsible for activity under your login.
• Provide accurate info and keep it updated.

3. Subscriptions & billing

• Free tier has usage caps.
• Paid plans auto‑renew monthly or annually at current list prices unless you cancel in the billing portal or email connor@peeker.ai before renewal.
• All fees are non‑refundable except under our Refund Policy.

4. Refund Policy

ALL PAYMENTS MADE TO PEEKER, INC. ARE FINAL AND NON-REFUNDABLE. By agreeing to these Terms, you acknowledge and accept that Peeker, Inc. does not provide refunds for any fees paid, regardless of usage or satisfaction with the Services. This includes, but is not limited to, subscription fees, one-time payments, and any other charges associated with your account. You further acknowledge that partial months of service, unused features, or early termination of your subscription do not entitle you to any form of refund or credit. This no-refund policy applies to all service tiers and payment plans without exception, unless otherwise required by applicable law.

5. Acceptable use

You may not:

• Break the law, infringe IP, or violate spam laws using Peeker.
• Upload cardholder data, personal health info, or data about minors.
• Copy, scrape, or resell Peeker data or credits without written permission.
• Attempt to hack, disrupt, or reverse‑engineer the platform.

6. Your content

You own the data you upload. You grant Peeker a limited license to store, back‑up, and process it so the Services function. We don't share it with other customers or train models on it.

7. Our IP

Peeker's software, design, and trademarks belong to Peeker, Inc. All rights not expressly granted are reserved.

8. Service changes & downtime

We continually improve the product and may add, change, or remove features. We aim for 99.9% monthly uptime but don't guarantee it.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY. We disclaim implied warranties of merchantability, fitness for a particular purpose, and non‑infringement.

10. Limitation of liability

Peeker's total liability arising from these Terms will not exceed (a) fees you paid Peeker in the prior 3 months or (b) USD $100, whichever is greater. We're not liable for indirect or consequential damages.

11. Indemnity

You'll indemnify Peeker from claims arising out of your misuse of the Services or breach of these Terms.

12. Termination

You can stop using Peeker any time. We may suspend or terminate your account for violations. Sections 5–11 survive termination.

13. Governing law

New York law governs, except its conflict‑of‑law rules.

14. Dispute resolution & arbitration (U.S. customers)

After a 60‑day informal negotiation period, any unresolved dispute will be settled by binding arbitration in New York County, NY, administered by the American Arbitration Association. Class actions are waived. You can opt out within 30 days of creating your account by emailing connor@peeker.ai.
